Terms and Conditions – General Terms and Conditions
The booking of travel services from Nurtur eK is based on the following travel and business conditions. Separate brokerage conditions apply to the booking of services from the Internet.
1. Travel Contract
1.1 The Nurture e. K. expressly points out that the trip is a religiously required pilgrimage, so the traveler has not booked a vacation and it is clear to him that he cannot reasonably expect the comfort of an ordinary vacation. During the Hajj we lodged in simple tents in Mina and Arafat, and in Musdalifa we slept under the open sky, like all pilgrims. Accommodation during this part of the Hajj is organized by the Hajj Ministry. The tents are very basic and it is very narrow. According to the decision of the Saudi Arabian Hajj Ministry, everyone must
1.2 The content of the travel contract is determined by the travel brochures of Nurtur e. K. The traveler transmits to Nurtur e. K. Usually in writing, by fax or by email, the registration form and offers the conclusion of a travel contract on the basis of the service description in the offer.
1.3 The travel contract comes into effect upon receipt of the written travel confirmation from Nurtur e. K. Upon receipt of this declaration of acceptance incl. Information on price and services and - as far as Nurtur e. K. is subject to the obligation to protect customer money - the legally required security certificate, the travel contract is legally binding.
1.4 The person registering is liable for all obligations of co-registered travelers from the travel contract.
1.5 Travel agents (eg travel agencies) and service providers (eg hotels, transport companies) are protected by Nurtur e. K. is not authorized to make agreements, provide information or make assurances that change the agreed content of the travel contract, go beyond the contractually agreed services of the tour operator or contradict the travel description.
2. Services and Changes in Services
2.1 The scope and nature of the contractual services result from the service description of Nurtur e. K. as well as from the information in the travel confirmation referring to this. Ancillary agreements that change this determination of the contractual services must be in writing.
2.2 The Nurture e. K. is entitled to make changes to services if these change due to circumstances beyond Nurtur e. K. arise after the conclusion of the contract. This includes, among other things, the exchange of the specified accommodation or the specified transport if the standard is largely identical. The nurture e. K. is obliged to inform the traveler immediately about changes and deviations in service.
3. Prices and terms of payment
3.1 The traveler is obliged to pay the price agreed for the booked travel services. A deposit of 30% of the travel price per traveler is to be paid upon conclusion of the contract. The remaining payment will be made 5 days after receipt of the travel confirmation by Nurtur e. K. due. After receipt of payment, the traveler will receive the travel documents. In the case of short-term bookings, the travel price is due immediately. For bookings made 7 days or more before departure, a cash deposit or bank-confirmed proof of payment is required.
3.2 If the remaining payment is not received within 5 days after receipt of the travel confirmation and if no payment is made after a request and a reasonable deadline, Nurtur e. K. is entitled to terminate the contract without notice and to cancel the booking. In this case, Nurtur e. K. claim the costs calculated according to Section 5 as compensation.
3.3 The prices include the applicable VAT. If the period between the conclusion of the contract and the fulfillment of the contract exceeds four months and the transport costs increase after the conclusion of the contract, the agreed price can be changed in proportion to the increase per person on the agreed travel price. Nurtur e. K. inform the traveler immediately. However, a price change is only possible up to the 21st day before departure. If the price increases by more than 5% of the travel price, the traveler is entitled to withdraw from the travel contract without fees or to take part in another, at least equivalent trip from the Nurtur e. K. to request it if it is able to offer one. The traveler has the aforementioned rights immediately after the declaration by Nurtur e. K. about the price increase.
3.4 For price reductions that are linked to age, the age at the start of the trip and not the age at the time of booking is decisive and must therefore be specified by the traveler when booking. If the age is incorrect, an additional charge will be made in the amount of the difference to the age-related travel price according to the advertisement.
4. Withdrawal and Termination
4.1 The traveler is entitled to withdraw from the trip at any time. The withdrawal is made in writing if possible, enclosing the travel documents. The receipt of the declaration of withdrawal by Nurtur e. K
4.2 If the traveler withdraws from the travel contract or does not start the trip, Nurtur e. K. Demand compensation for the travel arrangements made and for their expenses. The amount of the compensation is determined according to § 651i Para. 2 BGB according to the travel price less the value of the expenses saved by the tour operator and what he can acquire through other use of the travel services.
4.3 Nurture e. K. can also flat-rate its claim for compensation as a percentage of the travel price, taking into account the following breakdown:
- from 2 weeks after travel registration 3%
- from 3 months before the start of the trip 15% - from 6 weeks before the start of the trip (especially after obtaining a visa) 80%
- from 2 weeks before the start of the trip 90%
- from 1 week before the start of the trip 100%
4.4 Costs such as visa, telephone or processing costs cannot be reimbursed in the event of cancellation of the trip. The reimbursement of individual travel services that are not used due to a premature return trip or other compelling reasons is excluded.
4.5 The Nurture e. K. can withdraw from the contract for important reasons, in particular if a minimum number of participants specified in the travel description is not reached or if Nurtur e. K. it is unreasonable to carry out the trip because the economic victim limit has been exceeded due to circumstances for which she is not responsible. The cancellation must be declared to the traveler immediately if it is certain that the trip will not be carried out.
4.6 In the cases of Section 5.5, the traveler will receive the paid travel price back immediately if he does not exercise his right to book another trip of at least equal value from the Nurtur e. K. to book. The traveler has this right immediately after the declaration of cancellation of the trip to Nurtur e. K. to assert.
4.7 Nurture e. K. can terminate the travel contract without notice if the traveler persistently disrupts the execution of the trip, despite a warning from the tour operator, or if he behaves in breach of contract to such an extent that the immediate cancellation of the contract is justified. Announces the Nurtur e. K., he retains the right to the travel price. Claims for damages by Nurtur e. K. remain unaffected.
5. Passport, visa and health regulations
5.1 The traveler is responsible for compliance with all regulations important for the implementation of the trip. All documents required for obtaining a visa must be submitted to Nurtur e. K. be submitted.
5.2 The Nurture e. K. will inform the travelers about all known health regulations and recommended prophylaxis for the respective destination. It is also recommended to contact a doctor or a tropical institute.
6. Liability, Limitation of Liability and Duty of Disclosure
6.1 Nurture e. K. is not liable for disruptions in performance in connection with services that are only mediated as third-party services and that are expressly marked as third-party services in the service description. Nurtur e. K. only for proper mediation.
6.2 The Nurture e. K. assumes no liability for loss, theft, delays or irregularities in flight and travel times. In addition, Nurtur e. K. not in the case of impairment of the trip due to force majeure, such as strikes, war, civil unrest, natural and other catastrophes, epidemics, environmental pollution, decrees of the authorities, etc.
6.3 Liability for carriage in international air transport in the event of death or personal injury to passengers, delays to passengers and/or luggage, and destruction, loss or damage to luggage is subject to the provisions of the Warsaw Convention or the Montreal Convention.
6.4 If damage was caused neither intentionally nor through gross negligence by Nurtur e. K. has been brought about or the Nurtur e. K. is solely responsible due to the fault of a service provider, liability for damage that is not physical damage is limited to three times the travel price. Claims from tortious liability remain unaffected.
6.5 Claims for non-contractual provision of the trip must be made against the tour operator Nurtur e. K. to assert in writing. After the deadline, the traveler can only assert claims if he was prevented from meeting the deadline through no fault of his own.
6.6 Claims of the traveler according to §§ 651 c to 651 f BGB from injury to life, limb or health, which are based on an intentional or negligent breach of duty by Nurtur e. K. or his legal representative or vicarious agent expire in 2 years. This also applies to claims for compensation for other damages based on an intentional or grossly negligent breach of duty by Nurtur e. K. or his legal representative or vicarious agent of the tour operator. All other claims according to §§ 651c to f BGB expire after 1 year. The statute of limitations begins on the day on which the trip should end according to the contract.
6.7 An assignment of claims against the tour operator to third parties who are not travelers is excluded.
7. Travel Insurance
Unless expressly stated otherwise, the travel price does not include travel insurance. The nurture e. K. recommends taking out travel cancellation insurance, travel liability insurance, health and accident insurance and insurance to cover repatriation costs in the event of an accident or illness. As far as Nurtur e. K. offers travel insurance, this is only an intermediary service. The insurance contract is concluded exclusively between the customer and the specified travel insurer. Claims can only be asserted directly against the insurer. The traveler must observe the insurance conditions and obligations arising from the insurance contract. The premium for insurance is not part of the travel price and is due for payment immediately upon conclusion of the insurance.
8. Obligations to cooperate
8.1 The traveler is obliged to cooperate within the scope of the statutory provisions in the event of service disruptions, to avoid or minimize any damage. In particular, the traveler is obliged to inform the local tour guide of his complaints immediately. This is commissioned to take remedial action if this is possible. If the traveler culpably fails to report a defect, a claim for reduction does not arise.
8.2 The passenger is advised that charter flights often have very short-term changes, including bringing forward the departure times for the return flight. In order to avoid damage, it is therefore essential that the passenger informs Nurtur e. K. can be reconfirmed and made sure of the exact return flight date. A culpable omission of this cooperation represents a breach of obligation on the part of the traveler and can lead to a reduction in the claim or the exclusion of a claim.
9. Consent to the publication and distribution of images according to § 22 KunstUrhG
The traveler agrees that images of the traveler may be photographed by Nurtur e. K. may be edited in any form. The nurture e. K. may reproduce, exhibit and publicly reproduce the images without any restrictions on the spatial, temporal or content-related area of use, free of charge and for all possible purposes and media. This also applies to the unedited portrait. The traveler recognizes the Nurtur e. K. as the author of the image processing and grants Nurtur e. K. acquires the exclusive right to use the edited images. The traveler permits any non-commercial use including self-promotion, participation in artistic exhibitions and use in publications. The nurture e. K grants the traveler the possibility of non-commercial use of the edited images. This agreement is irrevocable and also binding for heirs or other legal successors.
The place of jurisdiction of Nurtur e. K. is Ansbach. In the event that the contractual partner of Nurtur e. K. has no general place of jurisdiction in Germany or the party to be sued moves its registered office or place of residence outside the scope of the law of the Federal Republic of Germany after the conclusion of the contract or its registered office or place of residence is not known at the time the action is filed, and in the event that the contractual partner of Nurtur e. K. are merchants, Ansbach is agreed as the place of jurisdiction.
